يتناول هذا البحث بشكل نقدي الحماية الدولية لتعليم الأطفال أثناء النزاع السوري المسلح منذ عام 2011. ويحدد الأسباب الكامنة وراء فشل المجتمع الدولي في توفير الحماية اللازمة وآثارها على تعليم الأطفال السوريين. ويحلل الحماية القانونية المتاحة لتعليم الأطفال في حالات النزاع المسلح وفقا للقانون الدولي. من أجل تقييم تردد المجتمع الدولي في التدخل الإنساني بموجب مبدأ مسؤولية الحماية، اعتمد هذا البحث أسلوب التحليل التفسيري من خلال استخدام المنهج التحليلي النصي ونظريات الواقعية والليبرالية. بالإجمال، خلال السنوات الثماني من النزاع السوري المستمر، تم انتهاك حق الأطفال في التعليم في جميع أنحاء سوريا وخرج الملايين من المدارس والعديد منهم معرضون بشكل كبير للتسرب. وخلص البحث إلى أن استخدام حق النقض في مجلس الأمن والاعتبارات السياسية والاقتصادية للقوى العظمى قد تفوق على الحماية القانونية للتعليم.

The extent to which the international community responds to the principle of international protection for the education of Syrian children during the conflict

This research critically examines the international protection of children education during the Syrian armed conflict since 2011. It identifies the reasons behind the failure of the international community in providing the necessary protection and its impacts on the Syrian children education. It analyzes the legal protection available to children education in situations of armed conflict in accordance with the international law. In order to evaluate the reluctance of the international community humanitarian intervention under the principle of Responsibility to Protect, this research adopted the explanatory analytical approach through using the textual analysis method and the realism and liberalism theories. Altogether, during the eight years of the ongoing Syrian conflict, children right to education have been violated throughout Syria and millions have been out of schools and many are at high risk to dropout. The research concludes that the vetoes in the Security Council and political and economic considerations among the superpowers have overcome the legal protection.

مدى استجابة المجتمع الدولي لمبدأ الحماية الدولية لتعليم الأطفال السوريين خلال النزاع

Özet

Bu makale, 2011’den beri Suriye’deki silahlı çatışması sırasında çocukların eğitimine yönelik uluslararası koruma konusunu eleştirel bir şekilde incelemekte, uluslararası toplumun gerekli korumayı sağlamadaki başarısızlığının ardındaki nedenleri ve bunların Suriyeli çocukların eğitimi üzerindeki sonuçlarını ele almakta ve uluslararası hukuka uygun olarak silahlı çatışma durumlarında çocukların eğitimi için mevcut yasal koruma konusunu analiz etmektedir. Bu araştırma, koruma sorumluluğu ilkesi gereğince uluslararası toplumun müdahale konusundaki tereddüdünü değerlendirmek üzere metinsel analitik yaklaşım ile realist ve liberal teorileri kullanarak yorumlayıcı analiz yöntemini benimsemiştir. Sonuç olarak,  sekiz yıldır devam eden Suriye’deki çatışma boyunca Suriye genelinde çocukların eğitim hakkı ihlal edilmiş ve milyonlarca kişi okulu bırakmıştır. Birçoğu da büyük oranda okulu bırakma riski altındadır. Araştırma, Güvenlik Konseyi’nde veto yetkisinin kullanımının ve büyük güçlerin siyasi ve ekonomik önceliklerinin, eğitimin yasal korumasından daha baskın olabileceği sonucuna varmıştır.
